GENERAL TERMS AND CONDITIONS
Online Purchase of Istobal Products
These Terms and Conditions shall apply to all purchases of products offered on the website https://shop.istobal.com (hereinafter "Products"). Together with the offer, price and description of said products as set out on this website, and, where appropriate, the particular conditions contained in this document (special conditions), these provisions shall govern the legal relationship between ISTOBAL España S.L.U, hereinafter ("ISTOBAL") webmaster for the https://shop.istobal.com site, and the CUSTOMER, constituting the entire agreement between ISTOBAL and the CUSTOMER.
These Terms and Conditions shall continue to apply as long as they remain published online, governing the purchase of products at the time at which said conditions prevail.
Sorry, but we can only accept purchases made by adults. If you are a minor, you must tell your parents or guardians about the Terms and Conditions of Purchase. Your parents or guardians must express their acceptance of these conditions before the website is used or any purchases are made.
Identification of the Parties
Party (1): ISTOBAL España S.L.U, hereafter “ISTOBAL”, holder of CIF (Spanish Tax ID no.) B98591233, domiciled at Avda. Conde de Serrallo, 10, 46250, L'Alcúdia (VALENCIA) and registered in the Commercial Register of Valencia, Volume 3319, Folio 134, Sheet V8840, General Section of Companies Register 632.
Party (2): the CUSTOMER, of legal age, who has entered his/her data in the corresponding forms. All the information provided in these forms has been entered directly by the CUSTOMER, hence the responsibility for the authenticity of this data lies directly and exclusively with the CUSTOMER.
Purpose of the Contract
By accepting these Terms and Conditions, ISTOBAL undertakes to supply the CUSTOMER with the Products purchased in the online shop https://shop.istobal.com and the CUSTOMER agrees to pay the price indicated at the time of purchase.
In order to purchase the Products advertised by ISTOBAL on its website , https://shop.istobal.com , customers must first register on said website. The CUSTOMER may register at any time before initiating the booking process or, where appropriate, before confirming the reservation.
Customers must have reached legal age according to Spanish law in order to register. A date of birth must be provided for this purpose in the registration form.
The CUSTOMER is solely responsible for the quality of the data entered in the forms as part of the registration process, complying with the duty to provide truthful, accurate and complete data about his/her identity as requested in the registration, purchase and accreditation forms. The CUSTOMER also agrees to update all registration data to ensure this information remains truthful, accurate and complete.
The CUSTOMER may modify and/or update his/her data at any time by accessing his/her user profile in the "MY ACCOUNT" section on the portal; however, to avoid any inconvenience in the future, we recommend checking that the information entered and/or modified here is correct, particularly the full email address and contact phone number provided.
Once the CUSTOMER has entered his/her details and clicked the registration button, we will send a confirmation email to verify that the data provided to us during registration is correct. This email is usually sent and received automatically, and always within 24 hours of the registration request being submitted. If this email has not been received within said time period, this may be due to a one-off failure in communication or an error in the email address provided. In either case, please email us as soon as possible at email@example.com
If any of the data provided by the CUSTOMER is false, inaccurate or incomplete, or if ISTOBAL has sufficient grounds to suspect that such information is false, inaccurate or incomplete, ISTOBAL shall have the right to deny the CUSTOMER access to, and use of, the website or any of its services, now and in the future.
In accordance with the provisions of Organic Law 15/1999, of 13 December 1999, the CUSTOMER's personal data will be kept in a file which is used solely to manage purchases made via the online shop https://shop.istobal.com as well as to send out information about our offers and promotions, assuring the CUSTOMER that his/her data will remain confidential.
All information about the Products offered by ISTOBAL, including but not limited to prices features, description, size and content, is available for the CUSTOMER to view on the ISTOBAL website and will appear on screen in each case.
We try to ensure that the descriptions of the products displayed next to each product are as accurate and useful for the CUSTOMER as possible. However, the colours displayed on screen may differ from the original colour of the product.
The photographs and information on each product sheet are provided purely for informative purposes; ISTOBAL therefore accepts no liability for the appearance of potential errors in this information.
The features and prices of the Products for the Spanish market are shown on the screen in Euros and do not include VAT or any other applicable taxes . The relevant taxes will be applied to the shopping cart and invoice, broken down in a clear summary.
Any special promotions or discounts due to the Customer will also appear on screen.
The prices listed on the website are in effect at the time of publication and override all previously published prices. ISTOBAL undertakes to make every effort to maintain these prices; however, we reserve the right to modify these prices without prior notice, notifying the Customer of any changes when the order is placed. Any changes in prices will not affect orders that have already been placed.
To avoid confusion or issues with the provision of the Service and the delivery of said products, any personal data provided must be of the utmost accuracy.
The desired Products must be selected and added to the basket by clicking on the corresponding icon.
Once the desired products have been selected, the CUSTOMER must access the basket in order to purchase the products by completing the corresponding purchase form that will appear on screen next to a summary of the selected Products, the total price, the applicable taxes and any shipping costs (if relevant).
The verification of such data shall be the sole and exclusive responsibility of the CUSTOMER. ISOBAL shall not be liable to the CUSTOMER for any errors or inaccuracies of the order if ISTOBAL has sent the Products contained in the order confirmation.
Once the purchase form has been completed, the CUSTOMER must accept these Terms and Conditions, then select the desired payment method and confirm the Purchase. Depending on the payment method selected, the CUSTOMER may be redirected to an online payment platform in order to finalize the purchase using any of the accepted payment methods.
When the transaction has been confirmed, the CUSTOMER will receive an email containing the order information. If this email has not been received, it may be due to an intermittent network communications issue or an error when typing the provided email address. In both cases, we advise the CUSTOMER to email customer services at the following address: firstname.lastname@example.org.
The CUSTOMER is also advised to check the details provided in said email and to contact customer services at email@example.com if any errors are detected.
Payment Methods and Security
ISTOBAL accepts orders at any time, 24 hours a day, 7 days a week.
CUSTOMERS who have entered into a pre-purchase agreement with ISTOBAL may use the payment method previously agreed upon between the CUSTOMER and ISTOBAL. If no agreement has been concluded, and for new CUSTOMERS, payment will only be accepted by VISA, MASTERCARD or AMERICAN EXPRESS credit card. Any form of payment other than the above will not be accepted.
When paying by credit card, the charge will be made online, that is, in real time, through the virtual POS terminal provided by Banco de Sabadell, once it has been verified that the data provided is correct.
Confidential data (credit card number, expiry date and CVV) are not sent to our server, but are transmitted directly and in encrypted form to the Banco de Sabadell server . ISTOBAL does not have access to this information.
ISTOBAL reserves the right to withhold any order for security reasons, as well as to temporarily deny access to the purchased Products. The CUSTOMERS concerned will be notified accordingly. Likewise, ISTOBAL reserves the right to cancel an order if it transpires that the data supplied by the CUSTOMER cannot be verified or that the Product has been ordered by the CUSTOMER for resale.
ISTOBAL will not be responsible for any delays in the delivery of orders that are caused by a lack of authorization by the payment system.
ISTOBAL delivers products and services throughout Spain, excluding the Canary Islands. The delivery costs will be borne by the CUSTOMER unless otherwise stated on the website . These charges will be displayed on screen at the time of purchase, along with the estimated delivery time.
The delivery times of the products indicated when the order is placed are estimated and are not linked to specific delivery times. In any case, the maximum estimated delivery period will be six (6) working days from the date on which the order is processed.
ISTOBAL does not currently offer international shipping for its Products.
Orders will be processed within 48 working hours following order confirmation and validation of the payment method. The CUSTOMER can check the status of the order at any time by accessing the “MY ACCOUNT” section.
In case of force majeure that prevents or delays the delivery of the product and/or service, this will be made known to the CUSTOMER with a new suggested delivery date for the Product, without any liability for ISTOBAL. Cases of force majeure will be understood as anything that prevents the delivery of the order through causes unrelated to either party, including but not limited to strikes, war, flood or other natural disaster, lack of materials or impossibility of supplying materials, etc..
Deliveries will be made to the address provided by the CUSTOMER. Deliveries will not be made to PO boxes.
All deliveries shall require a signature upon receipt. Once signed for, the goods are the responsibility of the CUSTOMER.
It is vital to fill in the corresponding form correctly in order to avoid any issues with delivery. The phone number and contact email fields are mandatory.
Billing E-Billing Terms and Conditions
Upon acceptance and in accordance with the provisions of Royal Decree 16/19/2012 of 30 November 2012, which approves the Billing Regulation, invoices sent by ISTOBAL will comply with the following procedure:
The invoice will be generated in PDF format and sent as an attachment by email to the address provided for this purpose. We have set up a specific email address for the review of electronic invoices, so this will be the only channel for sending these invoices. The email address set up for this purpose is: firstname.lastname@example.org.
If you decide to revoke this consent, it is sufficient for you to notify us by email at email@example.com
The CUSTOMER may cancel the order of any product without any charge, provided that the order has not yet been shipped.
To cancel the order, the CUSTOMER must contact the customer service department on +34 902 509 444 , indicating their order number.
If the order has been delivered, it cannot be cancelled. However, the CUSTOMER may return their order once it has been received, in accordance with the following conditions for returns.
Withdrawal, Returns and Exchanges
As a CUSTOMER, if you are not satisfied when you have received a Product you have purchased, you will have a period of fourteen (14) calendar days from the date of receipt of the order in order to exercise your right of withdrawal, return or exchange.
The following conditions must be met if you wish to exercise the right to cancel, return or exchange the purchased product:
- The Product must be in perfect condition, with its original packaging. Likewise, it should not have been opened, unsealed or used.
- It must be returned in the same condition in which it was received with its original packaging intact.
- The return will be made using the carrier authorised by ISTOBAL.
The CUSTOMER has the right to withdraw from this contract within fourteen (14) calendar days without any justification.
The withdrawal period will expire fourteen (14) calendar days after the day on which the CUSTOMER, or a third party other than the carrier (to be indicated by the CUSTOMER), acquires material possession of the product.
To exercise the right of withdrawal, the CUSTOMER must notify us of his/her decision to withdraw from the contract by contacting ISTOBAL on +34 902 509 444 and we will send out a form to properly process this right.
In order to comply with the withdrawal period, it will suffice if the communication concerning the exercise of this right is sent before the expiry of the corresponding period.
Consequences of Withdrawal:
In case of withdrawal by the CUSTOMER, we will refund all payments received for the purchase, including delivery costs (with the exception of the additional costs incurred if the CUSTOMER has chosen a delivery method other than the least expensive standard delivery method we offer) without undue delay and, in any event, no later than fourteen (14) calendar days from the date on which we are informed of the CUSTOMER's decision to withdraw from this contract. We will proceed to make said refund using the same means of payment used by the CUSTOMER for the initial transaction, unless the CUSTOMER has expressly indicated otherwise; in any case, the CUSTOMER will not incur any expenses as a result of the refund.
Notwithstanding the foregoing, we may withhold the refund until we have received the Products, or until the CUSTOMER has presented proof of return, depending on which condition is met first.
The CUSTOMER must return the goods to us by attaching the completed form and using the carrier assigned by ISTOBAL. The address for returns is: Lavantia Nature S.L, calle Deyang s/n Bajo. P.I. La Creu, 46250, L´Alcúdia (Valencia).
In any case, the return of the goods will be made without undue delay and no later than fourteen (14) calendar days from the date on which the CUSTOMER notifies us of his/her decision to withdraw from the contract. The deadline shall be deemed to have been met if the return of the goods is completed before the end of that period.
The CUSTOMER must bear the direct cost of returning the Product.
The CUSTOMER will only be responsible for the decrease in value of the goods resulting from handling other than that necessary to establish the nature, characteristics and operation of the Products purchased.
We only accept returns of faulty items or items delivered in error by ISTOBAL. The CUSTOMER may request a return within fourteen (14) calendar days of acquiring material possession of the product. After this period, if the purchased product has any manufacturing or quality defects the CUSTOMER may assert the legally recognised warranty.
To make a return you must contact ISTOBAL by calling +34 902 509 444 . We will send you the returns form that you must attach to the goods and then contact the TXT carrier on +34 683 653 683.
For a return to be accepted, it must reach ISTOBAL in its original packaging, fully sealed and without any damage. It is the customer's obligation to keep a signed copy of the delivery documentation provided by the transport company.
Once the product has been received and its status has been checked, we will proceed to the ship the correct product at no additional cost to the CUSTOMER , unless the CUSTOMER requests a refund, in which case the full amount paid for the product will be refunded within a period of ten (10) business days. The refund will be made automatically using the same payment method used for the initial transaction.
To request an exchange, the CUSTOMER must contact customer service within fourteen (14) calendar days of acquriring material possession of the product.
The shipping and collection costs in the event of an exchange will be borne by the CUSTOMER. Freight collect shipments will not be accepted under any circumstances.

Products offered through our website are guaranteed for two (2) years for manufacturing defects, except for chemical products, which have a 1-year warranty. To assert the warranty within the established legal period, it will be essential to present the proof of purchase. This can be done via the email@example.com email address.
The warranty does not cover cases where wear or defect is caused by misuse of the product by the CUSTOMER, normal wear and tear of the product or deficiencies caused by negligence, shock, use or improper handling, or materials subject to wear and tear due to normal use, as well as those in which part of the warranty or proof of purchase data has been modified, altered or replaced and/or the product has been tampered with or repaired by third parties other than ISTOBAL.
In cases that justify the use of the warranty, the item will be repaired, replaced, refunded or returned, under the legally established terms.
Likewise, ISTOBAL may offer an Additional Commercial Warranty, although this additional commercial warranty may be limited to certain products or certain specific features. In such a case, this will be specified in each individual product description, available on the website.
Intellectual and Industrial Property
ISTOBAL assures the CUSTOMER that it is the owner of the intellectual and industrial property rights to the Products sold on its website and/ or, where appropriate, that it has the necessary authorization to market said products through its website.
The CUSTOMER acknowledges and accepts that the Products, as well as their contents, packaging, materials, etc., are subject to Intellectual and Industrial Property rights, the ownership of which corresponds to ISTOBAL and/or third parties.
The acquisition of the Products and navigation on the ISTOBAL website shall in no case be understood as a waiver, transmission, license or total or partial transfer to the CUSTOMER of the intellectual and industrial property rights held by ISTOBAL or, where applicable, of the third party to which they correspond. The CUSTOMER may not in any case alter, exploit, reproduce, distribute or publicly communicate the Website, its contents or the products acquired through it, without the prior and express authorization specifically granted, for this purpose, by ISTOBAL or, by the third party to which they correspond.
Modifications of the Terms and Conditions
ISTOBAL reserves the right to modify this agreement, when it deems it appropriate or with the purpose of adapting such texts to legislative or technological changes or to their contractual relationship with third parties. The CUSTOMER will be duly informed of such modifications.
If any part of the contract terms and conditions is contrary to law and therefore invalid, this shall not affect the other provisions in accordance with law. The parties undertake to renegotiate those parts of the contract terms and conditions that would be void and to incorporate them into the rest of the contract terms and conditions.
Exclusion of Warranties and Liability
ISTOBAL shall not be responsible for any delays or failures in the access, operation and operation of the website, or its Products, nor for interruptions, suspensions or malfunction thereof due to reasons beyond ISTOBAL 's control or issues caused by natural disasters or situations of force majeure, or extreme emergency, such as strikes, attacks or computer intrusions (computer viruses affecting users' devices) or any other force majeure or fortuitous cause.
ISTOBAL reserves the right to interrupt access to its website www.shop.istobal.com, as well as the provision of any or all of the contents provided through them at any time and without prior notice, either for technical, security, control or maintenance reasons, or any type of failure in telecommunications or power supply networks.
ISTOBAL shall not be liable in case of service failures, malfunction or any other cause that does not have direct control over them or that has its origin in the malicious or culpable actions of the user, or for reasons of force majeure, or those attributable to third parties.
ISTOBAL is not liable for any information, data, images of any kind and links published on its website from third parties without assuming any guarantee as to the veracity and accuracy of the information that is made available to the CUSTOMERS or that are provided by the CUSTOMERS themselves.
Likewise, it shall not be liable for any direct or indirect damage, consequential damage and/or loss of profit.
The CUSTOMER shall indemnify ISTOBAL against any liability that may arise from the claims of third parties regarding the infringement of rights that may result from its action.
These General Terms and Conditions are governed by the applicable Spanish legislation.
The intervening parties undertake to amicably resolve any disputes that may arise regarding these terms and conditions. In the event that an amicable resolution cannot be reached, and a legal dispute is appropriate, both parties agree, expressly waiving any other jurisdiction that may correspond to them, and provided that the Law allows it to submit, to the jurisdiction and competence of the Courts of Valencia.
